Benitez vs. Credit Control Services, Inc. (January 16, 2014) – Case No. 13-21295. Plaintiff alleged the our client Credit Control Services, Inc. (“CCS”), violated the Telephone Consumer Protection Act (“TCPA”) by calling her cellphone to collect a debt owed by her mother and step-father. At trial, we were able to prove that Plaintiff herself called the creditor Allstate Insurance and provided her cellphone number to Allstate, thereby giving CCS consent to call the cellphone number for debt collection purposes.
