Tourtelot vs. Urban Retail Property, et al(M.D. Fla. – August 25, 2011) – Case No. 11-cv-1008. Plaintiff alleged our client, a security company, was negligent in failing to prevent a third party attack on Plaintiff. In granting our client’s motion to dismiss, the court held that Plaintiff’s complaint failed to state a cause of action as a matter of law due to the fact that Plaintiff had failed to allege facts demonstrating that our client had “actual or constructive knowledge of prior similar acts committed upon invitees on the premises.”
