Smith vs. The Groves (State Court, Sixth Judicial Circuit, Pasco County) – Case No. 51-2011-CA-3666-ES. Plaintiff, an employee of independent contractor working on the property in question, filed a negligence action against property owner after sustaining a knee injury while on the property and resulting ACL tear. Motion  for Summary Judgment granted in favor of Defendant property owner has no duty to as employee of an independent contractor when said employee is injured as a result of defects of which they have constructive knowledge.  Motion for Summary Judgment granted by Judge Babb.
